How does the probate process work?

Probate refers to obtaining the authority required to carry out necessary tasks after a bereavement. It allows you to deal with the personal property of the deceased. We can tell you whether you need to apply for probate and guide you through the process.
There are two ways in which you might deal with a person’s estate after their death. If the person has left a Will, you will require a Grant of Probate. If they have not left a Will, or if the court has ruled it invalid, you will need a Grant of Letters of Administration.
In both instances, we can help you to establish whether probate is required. If all the deceased’s assets were owned jointly, or the worth of their estate amounts to less than a certain value, then you may not need to apply.
The next step is to ascertain the value of the estate by establishing its assets and debts. Ordinarily, this will require a physical search of documents and personal effects belonging to the deceased, as well as relevant enquiries with banks and other financial institutions.
Finally, you can apply for a Grant of Probate or a Grant of Letters of Administration. In the Caribbean, your probate application must be made through an attorney if the estate is valued at over $4800.
